PLEASE READ THESE TERMS OF SERVICE CAREFULLY. THESE TERMS INCLUDE A MANDATORY ARBITRATION PROVISION AND CLASS ACTION WAIVER PROVISION, WHICH AFFECT YOUR RIGHTS ABOUT HOW TO RESOLVE ANY DISPUTE WITH MOTOGO INC. dba MY PATRIOT SHIRTS. BY ACCESSING OR USING OUR WEBSITE, APPLICATIONS OR OTHER PRODUCTS OR SERVICES (TOGETHER, THE “MY PATRIOT SHIRTS SERVICE”), YOU AGREE TO BE BOUND BY ALL TERMS DESCRIBED HEREIN AND ALL TERMS INCORPORATED BY REFERENCE (“TERMS”). IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT ACCESS OR USE THE MY PATRIOT SHIRTS SERVICE.

These Terms apply to your access to and use of the My Patriot Shirts Service provided by MotoGo, Inc. (“My Patriot Shirts,” “we” and “us”). Additional terms (including, but not limited to, the terms of social media services and third-party payment processors) may apply to particular functionalities and features related to the My Patriot Shirts Service.

1. Eligibility

ONLY USERS WHO ARE THIRTEEN (13) YEARS OF AGE OR OLDER MAY REGISTER FOR OR USE THE MY PATRIOT SHIRTS SERVICE. The My Patriot Shirts Service is not targeted towards, nor intended for use by, anyone under the age of thirteen (13). If you are between the ages of thirteen (13) and eighteen (18), you may use the My Patriot Shirts Service only under the supervision of a parent or legal guardian who agrees to be bound by these Terms and any applicable additional terms. You further represent and warrant that you: (a) have not previously been suspended or removed from using the My Patriot Shirts Service; (b) are legally permitted to, and do, live in the United States or one of its territories, and (c) may enter into this agreement without violating any other agreement to which you are a party. If you are registering to use the My Patriot Shirts Service on behalf of a legal entity, you further represent and warrant that (i) such legal entity is duly organized and validly existing under the applicable laws of the jurisdiction of its organization, and (ii) you are duly authorized by such legal entity to act on its behalf.

2. Account Registration and Security Responsibilities

A. Process. In order to access certain parts of the My Patriot Shirts Service, you may be required to create an My Patriot Shirts (an “Account”). In connection with creating an Account, you must provide certain information (“Registration Data”) and answer all questions or fields marked “required.” You agree to: (i) provide true, accurate, current and complete Registration Data; (ii) maintain and update such Registration Data to keep it true, accurate, current and complete; and (iii) consent to allow My Patriot Shirts to contact you for the purpose of confirming some or all of your Registration Data, to conduct research and to resolve disputes, as My Patriot Shirts may elect to do from time to time.

B. Facebook Connect. You may use your Facebook account to access and use the My Patriot Shirts Service by either linking your Account to your Facebook account or by logging into the My Patriot Shirts Service via your Facebook account. By accessing and using the My Patriot Shirts Service via your Facebook account, you acknowledge and agree that we may access your Facebook account to deliver and post messages regarding the My Patriot Shirts Service unless you opt-out. You also agree to the Facebook Terms of Use in connection with your use of the My Patriot Shirts Service.

C. Your Account Security Responsibilities. You are responsible for: (i) maintaining the confidentiality of your Account credentials, (ii) restricting access to your device and to your Account, (iii) all activities, charges and/or liabilities that occur from your Account, whether or not authorized by you, and (iv) promptly notifying us if you discover or otherwise suspect any security breaches related to your Account.

3. Privacy

Please refer to our Privacy Policy for information about how we collect, use and share information about individual users of the My Patriot Shirts Service.

4. Electronic Communications

When you use the My Patriot Shirts Service, send e-mails to us, or communicate with us via the My Patriot Shirts app or web site, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices through the My Patriot Shirts Service. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

5. Description of the MY PATRIOT SHIRTS Service

A. General. The My Patriot Shirts Service provides a simple and robust exchange for sharing Shooting Sports events and finding geographically amenable Shooting Sports resources. The My Patriot Shirts Service creates a place for Shooting Sports enthusiasts to connect, facilitates an avenue to communicate and share without disclosing a user’s email address, phone number or other personal contact information, and incorporates a seamless method for locating resources and offers to purchase goods or services. The My Patriot Shirts Service allows advertisers to purchase enhanced advertising opportunities to increase the reach and effectiveness of the My Patriot Shirts Service.

B. Payment Options.

1. My Patriot Shirts Payment Solution. An advertiser may pay with credit cards and other electronic payment methods (each an “Electronic Payment Method”) through the My Patriot Shirts Service. My Patriot Shirts has integrated with American Payment Solutions, a payment processing service (“FortisPay”), to allow advertisers to pay with certain Electronic Payment Methods (“My Patriot Shirts Payment Solution”). Advertisers who wish to use the My Patriot Shirts Payment Solution must register with My Patriot Shirts by creating an account. Enrollment in and usage of the My Patriot Shirts Payment Solution is voluntary. My Patriot Shirts may from time to time impose limits on your ability to make payments through the My Patriot Shirts Payment Solution. Additionally, FortisPay may impose its own limits and limitations on an advertiser’s use of the My Patriot Shirts Payment Solution.

My Patriot Shirts reserves the right to change its Service Fees from time to time.

3. Transactions.

A. Advertising Purchases and Services Regardless of the payment method chosen, ALL PURCHASES ARE FINAL, AND THERE ARE NO REFUNDS.

B. Other Purchases My Patriot Shirts additionally sells textiles and other accessories via its website. For all goods purchased a refund is available for items returned within 30 days from invoice date. All returned items must be in brand new condition and unworn, with all original packaging and tags attached. The cost of return shipping is the responsibility of the end consumer. Refunds are processed within 5 business days of receipt.

4. Taxes. My Patriot Shirts is based in Oregon. During your purchase the My Patriot Shirts Service will calculate the taxes, if any, apply to each transaction you complete via the My Patriot Shirts Service, including, for example, sales tax. It is also your responsibility to withhold, collect, report and remit the correct taxes to the appropriate tax authorities. My Patriot Shirts is not responsible for withholding, collecting, reporting, or remitting any sales, use, value added, or similar tax arising from any transaction you complete via the My Patriot Shirts Service.
